Introduction

These Terms of Service (“Terms”, “Terms of Service”) govern your use of our website located at BoostMatches.ai (“Service”) operated by Heinrichs Inteligencia Artificial LTDA (“us”, “we”, or “our”).

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood the Agreements, and agree to be bound by them.

If you don't agree with (or cannot comply with) the Agreements, then you may not use the Service, but please let us know by emailing at [email protected] so we can try to find a solution.

You confirm and warrant that you are at least 16 years old or are visiting this Site under the supervision of a parent or guardian.

1. Use License

We grant you permission to temporarily download one copy of the materials (information or software) on BoostMatches's Services for personal, non-commercial, and transitory viewing only. This is a license grant, not a transfer of title, and under this license, you may not:

• Modify or copy the materials;
• Use the materials for any commercial purpose or for any public display (commercial or non-commercial);
• Attempt to decompile or reverse engineer any software contained on BoostMatches's Site;
• Remove any copyright or other proprietary notations from the materials;
• Transfer the materials to another person for any purpose other than seeking a work position or 'mirror' the materials on any other server.

2. Account

To access certain features of our Services, you may need to register, and we may assign to you, or you may be required to select, a password and username or account identification. By registering, you agree to provide us with accurate and complete registration information and to promptly update any changes to such information.

You are solely responsible for maintaining the confidentiality of the password and identification assigned to you. You must notify us immediately of any unauthorized use of your password or account or any other security breach. Each time you use a password or identification, you will be deemed authorized to access and use our Services in a manner consistent with these Terms, and we have no obligation to investigate the authorization or source of such access or use.

YOU ARE SOLELY RESPONSIBLE FOR ALL ACCESS TO AND USE OF OUR SERVICES BY ANYONE USING THE PASSWORD AND IDENTIFICATION ORIGINALLY SELECTED BY, OR ASSIGNED TO, YOU, WHETHER OR NOT SUCH ACCESS AND USE IS ACTUALLY AUTHORIZED BY YOU, INCLUDING, WITHOUT LIMITATION, ALL COMMUNICATIONS AND TRANSMISSIONS AND ALL OBLIGATIONS (INCLUDING, WITHOUT LIMITATION, FINANCIAL OBLIGATIONS) INCURRED THROUGH SUCH ACCESS OR USE.

3. Disclaimer

The materials on BoostMatches's Services are provided 'as is'. We make no warranties, express or implied, and hereby disclaim and negate all other warranties, including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Furthermore, BoostMatches does not warrant or make any representations concerning the accuracy, expected results, or reliability of the use of the materials on its Services or otherwise relating to such materials or on any sites linked to its Services.

4. Limitations

In no event shall BoostMatches or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising from the use or inability to use the materials on BoostMatches's Services, even if BoostMatches or a BoostMatches authorized representative has been notified orally or in writing of the possibility of such damage. Since some jurisdictions do not allow limitations on implied warranties or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Revisions and Errata

The materials appearing on BoostMatches's Services may include technical, typographical, or photographic errors. We do not warrant that any of the materials on our Services are accurate, complete, or current. We may make changes to the materials contained on our Services at any time without notice. However, we do not make any commitment to update the materials.

6. Business Partners

BoostMatches has contractual relationships with business partners (partner employers, job recruitment agencies) who use our services to find prospective employees tailored to their needs. Based on criteria entered into our system, these business partners are provided with a list of resumes and cover letters of suitable potential employees (our users), provided that our users have granted consent to us to share their personal data with our business partners (for more information, please see our Privacy Policy). If they are interested in a user, they may contact him/her directly using the contact details provided in the user's resume and/or cover letter.

As our user, you may decide whether you wish to include your resume and/or cover letter (created through our Site) into the database through which our system selects suitable employees for our business partners. You may agree by giving your consent during the registration process on our Site. We provide the business partners with your resume and cover letter only based on your explicit consent granted during the registration process or later. Please read more about your rights related to consent in our Privacy Policy.

BoostMatches acts as an intermediary in any legal relationship established between our business partner and our user as a result of the services provided to our business partners and has no liability arising from such legal relationships.

7. Links

We have not reviewed all of the websites linked to our Services and are not responsible for the contents of any linked site. The inclusion of any link does not imply endorsement by BoostMatches of the site. Use of any such linked website is at the user's own risk.

8. Governing Law

Any claim relating to BoostMatches's Services shall be governed by the laws of Brazil, without regard to its conflict of law provisions.

9. Intellectual Property

For the purposes of these Terms and our Privacy Policy, 'content' is defined as any information, data, communications, software, photos, videos, graphics, music, sounds, and other material and services that can be viewed by users on our Site. By accepting these Terms and Privacy Policy, you acknowledge and agree that all content presented to you on our Services is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws, and is the sole property of BoostMatches.

You are permitted to use the content only as expressly authorized by us. Except for a single copy made for personal use only, you may not copy, reproduce, modify, republish, upload, post, transmit, or distribute any documents or information from our Services in any form or by any means without prior written permission from us, and you are solely responsible for obtaining permission before reusing any copyrighted material available on this Site.

Any unauthorized use of the materials appearing on our Services may violate copyright, trademark, and other applicable laws and could result in criminal or civil penalties.

11. Feedback

Separate from user content, you may have the opportunity to submit questions, comments, suggestions, reviews, ideas, plans, designs, notes, proposals, drawings, original or creative materials, and other information regarding this Site, us, and our products or services (collectively “Feedback“). You agree that Feedback is non-confidential and will become our sole property. We shall own exclusive rights, including all intellectual property rights, to such Feedback and shall be entitled to the unrestricted use and dissemination of the Feedback for any purpose, commercial or otherwise, without acknowledgment or compensation to you. Your personal data provided for Feedback purposes is processed in compliance with our Privacy Policy.

12. General Terms and Conditions for All Subscriptions

Subscriptions and one-off services are non-returnable. You may cancel your subscription, but no refunds will be provided for any remaining subscription period. An internet connection is required to use and manage your subscription. Without an internet connection, your software may stop functioning.

Subscription pricing is subject to change. New pricing takes effect upon the renewal of your subscription. Web App subscriptions—monthly, quarterly, and annual—already include a Mobile App subscription for the corresponding period, as long as the Web App subscription is paid for. The annual Mobile App subscription does not include a Web App Premium subscription of any kind.

By upgrading to a chosen Subscription, you grant us explicit consent to commence the provision of the Services before the expiry of the 14-day withdrawal period (please see Article 21 Termination) and acknowledge that you have been informed that your right to withdraw from the Subscription within the above 14-day period cannot be exercised.

Notwithstanding the above, if you are a new user first attempting to use our Services with a Subscription, we may provide you with a 14-day money-back guarantee. This 14-day money-back guarantee applies only once to the same user. If you later engage in another Subscription, you will not be entitled to another 14-day money-back guarantee.

13. Monthly Subscription

Monthly subscriptions are available for our Website App, at the price indicated on our Site. Your monthly subscription for BoostMatches will start after we receive your payment and will continue for a period of thirty days. When you purchase a monthly subscription, auto-renew is automatically selected in your account. At the end of the monthly subscription period, you will automatically be renewed and billed for an additional subscription term of 30 days. If you do not wish to renew your subscription, you must cancel it prior to the end of your current subscription term. You will remain on BoostMatches subscription until the last paid-for period expires.

14. Quarterly Subscription

Quarterly subscriptions are available for our Website App, at the price indicated on our Site. Your quarterly subscription for BoostMatches will start after we receive your payment and will continue for a period of ninety days. When you purchase a quarterly subscription, auto-renew is automatically selected in your account. At the end of the quarterly subscription period, you will automatically be renewed and billed for an additional subscription term of 90 days. If you do not wish to renew your subscription, you must cancel it prior to the end of your current subscription term. You will remain on BoostMatches subscription until the last paid-for period expires.

15. Annual Subscription

Annual subscriptions are available for our Web App, at the price indicated on our Site, and Mobile App at the price indicated in our Mobile App. Your annual subscription for the BoostMatches Web App will start upon receiving your payment and will continue for one year. Annual subscriptions are paid in full in advance. When you purchase an annual subscription, auto-renew is automatically selected in your account. At the end of the annual subscription period, BoostMatches will renew your subscription and bill you for another one-year term. If you do not wish to renew your subscription, you must cancel it prior to the end of your current subscription term. You will remain on BoostMatches subscription until the last paid-for period expires.

16. One-off Fees

One-off services, such as proofreading, are available in the Web App and Mobile App. The BoostMatches one-off service will start after we receive your payment.

Only valid credit cards or other payment methods acceptable to us may be used. By submitting your order, you represent and warrant that you are authorized to use the designated card or method and authorize us to charge your order (including taxes, credit card fees, any other amounts described on the Site) to that card or other method. If the card (or other method) cannot be verified, is invalid, or is not otherwise acceptable, your order may be suspended or canceled automatically.

17. Payment of Fees

Our prices for a Subscription do not include any third-party fees you incur in connection with using a Paid Service, including, without limitation, fees charged by your internet access provider, any wireless carrier charges for cellular or data services, and any other third-party applications or services you may use with the Paid Service; you are responsible for selecting and managing these other services and paying the fees associated with them.

18. Changes in Fees

We may change the price of any Subscription from time to time and add new fees and charges for certain features or to reflect a change in business or legal rules, but we will provide you with advance notice of changes in recurring subscription fees. Any increase in charges for the same Subscription would not apply until the expiration of your current billing cycle, unless otherwise specified in our notice, and would become effective no sooner than the next time you would be charged for that Subscription. If you do not agree to pay the new price or other applicable charges, you may choose not to renew the Subscription before the price change goes into effect, and your cancellation would be effective at the end of your current billing cycle.

19. Auto-renewal

We accept debit and credit cards as well as other forms of payment (e.g., PayPal transfers) as payment methods for Subscriptions. Payment methods may vary by country and may change over time. When you purchase a Subscription, the fees will be billed on or near the date of your purchase.

If you purchase a Subscription that renews automatically, such as monthly or annually, you agree that we may process your payment on each monthly, annual, or other renewal term (based on the billing cycle), on or near the calendar day corresponding to the start of your Subscription. Additionally, you agree that we have permission to retain and/or share with financial institutions and payment processing firms (including any institutions or firms we may engage in the future) information regarding your purchase and your submitted payment information to process your purchase, and to use the email address you provided to send you notices and disclosures related to renewals and recurring charges.

If your Subscription began on a day not contained in a subsequent month (e.g., your service began on January 30 and there is no February 30), BoostMatches will process your payment on or near the last day of such month.

20. Communications

When you use this Site or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this Site or through our other Services. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

Based on our legitimate interest, we may use your personal information to reach out to you with newsletters, marketing or promotional materials, and other information that may be of interest to you. You can opt-out of receiving any of these communications and advertisements from BoostMatches (please see our Privacy Policy for more details).

21. Termination

You may terminate these Terms at any time by closing your account, discontinuing your use of our Services (your account will be automatically canceled after 5 years from your last login), and providing us with a notice of termination. We reserve the right, without notice and at our sole discretion, to terminate your right to use this Site or any portion of this Site, and to block or prevent your future access to and use of this Site or any portion of this Site.

If we block your access to the Site without any reason, you have the right to a refund of the proportional part of the subscription for the remaining subscription period.

If you close your account, you may renew your access within 30 days from such closing. After 30 days, your account and data will be erased.

You also have the right to withdraw from the chosen Subscription (the distance contract) within 14 days from the moment of conclusion of the contract (upgrade to the chosen Subscription). Please note that by granting consent to commence the provision of the Services or by using the Services before the expiry of the withdrawal period, your right of withdrawal is lost once the Services have been fully provided.

22. No Third-Party Beneficiaries

These Terms are for the benefit of, and will be enforceable by, the parties only. They are not intended to confer any right or benefit on any third party or to create any obligations or liability of a party to any such third party.

23. Modifications to Site

We reserve the right to modify or discontinue, temporarily or permanently, this Site or any features or portions thereof without prior notice.

24. Severability

If any provision in these Terms is held to be invalid, void, or unenforceable, such provision (or the part making it invalid, void, or unenforceable) will be struck and will not affect the validity of the remaining provisions.

25. Termination and Change

BoostMatches may suspend or terminate the BoostMatches Referral Program or a user's ability to participate in the Referral Program at any time for any reason.

We reserve the right to suspend accounts or remove provisions if we notice any activity that we believe is abusive or fraudulent. We reserve the right to review and investigate all referral activities and to suspend accounts or modify referrals as deemed fair and appropriate. We also reserve the right to make future changes to provisions and discounts for BoostMatches users.

26. Updates to the Terms

We may update these Terms at any time without prior notice. If we modify these Terms, we will post the modifications on the BoostMatches.ai website. Continued participation in the Referral Program after any modification shall constitute your consent to such modifications and changes.
